Published this Tuesday (21), Normative Ordinance MME No. 140 establishes the procedures related to events occurring between September 1, 2023 and November 25, 2025 and defines the steps that must be followed by those interested in participating in the compensation mechanism.
The regulation operationalizes the mechanism foreseen in Law No. 15.269/2025 and establishes procedures for expressing interest, submitting and updating information, verifying and classifying cuts, and calculating the amounts involved. The signing of a Commitment Agreement with the Federal Government is also part of the process for participating in the mechanism.
How will the process work?
Interested parties must register their expression of interest through Celebra (System for Registering Interest for Compensation for Generation Cuts), a tool created by the MME specifically for this process. Following this registration, the remaining steps required to formalize the compensation process will be carried out.
The publication of the ordinance, however, does not mean that every cut in solar or wind power generation that occurs during the period will automatically result in payment. The events must go through stages of investigation and classification, according to the criteria established for inclusion in the mechanism.
The total amount of compensation for curtailment It is not yet defined, since the ordinance only establishes the procedures for the agents' adherence, the verification of the cuts, and the calculation of compensations. The amounts will only be known after these steps are completed.
