A JA Solar filed a patent infringement lawsuit against a solar panel manufacturer, whose name was not revealed, in the UPC (Unified Patent Court) from Europe.

A lawsuit, which includes complaints to the local Munich and Hamburg branches of the UPC, involves patents related to solar cells with tunnel oxide passivated contact (TOPCon). The information is from PV Tech.

O JA Solar's lawsuit focuses on two patents specific: EP 2 787 541 B1, which covers the characteristic structure of TOPCon cells, and EP 4 092 759 B1, which concerns the arrangement of electrodes in cells solar panels and the wires that connect the individual cells of a solar panel.

O UPC has juízes in seventeen European Union Member States, its role is to decide on infringement and validity of Unitary Patents and classic European Patents.

The first license was validated in Germany, Netherlands, Italy, France and United Kingdom, while the second was validated as a Unitary Patent and is applied by all UPC member states.

Um JA Solar spokesperson said that PI (Intellectual Property) is not just fashion, but commitment and that the stance in relation to patents guarantees leadership through innovative technology.

"We have a responsibility to protect our leadership position and we will continue to enforce our patent rights against those who attempt to sell infringing products in Europe and other markets,” he said.

Solar patent infringements are on the rise

Patent infringement in the photovoltaic energy market is becoming a recurring subject in Europe and the United States.

Em June 2024, in Europe, the solar energy manufacturer Maxeon Solar Technologies, based in Singapore, filed a patent infringement lawsuit against another company in the same segment, Aiko Solar.

A similar situation occurred in the Netherlands, which followed a process of solar cell patent infringement of further contact, which had been denied.

In the United States, within a month, the Maxeon Solar Technologies entered with various processes about alleged solar cell patent infringement TOPCon against manufacturers Hanwha Qcells, REC Solar and Canadian Solar.

Thin Film Manufacturer First Solar initiated investigations into potential patent infringements TOPCon from several solar cell manufacturers.
