Voting on PL 5829 in the Senate is postponed for health reasons of the rapporteur

The vote on PL 5829 (Bill n. 5829/2019), which was scheduled to take place in the Federal Senate throughout the afternoon of this Thursday (25), had to be postponed at the last minute for health reasons of Senator Marcos Rogério (DEM/RO), rapporteur of the text in the House.

With the unforeseen situation, the expectation of entities in the solar sector is that the document will return to the agenda at the beginning of next week.

“We spoke with other important parliamentarians and we are already working on a new strategy to approve PL 5829 in 2021”, said Marina Mayer, legal director of INEL (National Institute of Clean Energy).

PL 5829 aims to create the Legal Framework for DG (distributed generation) in Brazil, assigning to ANEEL (National Electric Energy Agency) the responsibility to consider technical, environmental and social attributes in the calculation of energy compensation.

Authored by deputy Silas Câmara (Republicanos-AM), the The proposal was approved in the Chamber of Deputies on August 18, under the rapporteur of Congressman Lafayette Andrada (Republicanos/MG). The document was discussed in a single round and had an absolute majority of votes, with 476 in favor, three against and three abstentions.

Since then, the text has remained in the Senate pending bureaucratic procedures. On September 20, senator Marcos Rogério was appointed as rapporteur for the project by the president of the Senate, Rodrigo Pacheco (DEM-MG).

To be approved and become law, the project requires a simple majority quorum. In other words, it has to be approved by more than 50% of senators, without significant changes. If approved with changes, the matter will return to the Chamber for a new vote.
