ANEEL Enel SP is given 10 days to present its final arguments in the termination process.

The agency has concluded the investigation phase of the process that could result in the termination of the distributor's concession contract.

The director of ANEEL (National Electric Energy Agency) Agnes Costa, rapporteur of the process that could lead to the termination of Enel SP's concession contract, informed the company of the conclusion of the procedural instruction phase.

In a letter sent to the president of the distributor, Guilherme Lencastre, the director also informed him that a ten-day period had been set for the São Paulo-based concessionaire to present its final arguments before the process moves forward.

The administrative procedure could result in the termination of the distributor's concession contract in São Paulo. Simultaneously, an appeal filed by the distributor against the decision that initiated the process is scheduled to be reviewed by the board of directors. ANEEL at the meeting this Tuesday (11).

Why is the termination of Enel SP's concession under review?

The process to terminate Enel-SP's concession was formally initiated by... ANEEL On April 7th of this year, amidst questions about the quality of services provided by the distributor, especially after episodes of prolonged power outages in the city of São Paulo and its metropolitan area.

The incidents, some of which were linked to extreme weather events, left millions of consumers without power and increased pressure from authorities and public agencies for measures related to the concession.

Since the process began, Enel SP has contested the procedure and filed appeals with the Agency. Among its arguments, the distributor requested the annulment and dismissal of the process, alleging the existence of procedural flaws.

What does Enel SP say about the 10-day deadline?

Sought by Canal SolarThe company claimed that it has shown improvements in its performance, both under normal operating conditions and in situations of extreme weather events.

"Over the past two years, the company has shown significant improvement in prolonged outages and in the Average Emergency Response Time (AET), an indicator requested by Aneel since 2024. In the extreme event of December 2025, the distributor recovered 80,2% of the total impacted customers within 24 hours," the company reported.

According to Enel SP, the request for reassessment submitted by the company takes into account the distinct characteristics of the December event — a cyclone with strong winds for more than nine consecutive hours — which differ from previous events of short duration.

“This difference gave rise to a technical disagreement regarding the methodology used to measure the company's performance. Enel continues to act transparently and collaboratively to demonstrate full compliance with the goals established in the contract and in the improvement plan presented to the regulator in 2024, reaffirming its commitment to the quality of service provided to its more than 8,5 million customers in Greater São Paulo,” the distributor concluded.
