The Brazilian Ministry of Mines and Energy (MME) has launched a public consultation on the decree that regulates activities related to Carbon Capture and Storage, Carbon Capture, Utilization and Storage, and Bioenergy with Carbon Capture and Storage.
The proposal from Public Consultation 205/2025 establishes legal, environmental, and operational guidelines to enable the use of these technologies in the country, considered strategic for reducing greenhouse gas emissions. The focus is mainly on sectors that are difficult to decarbonize, such as steel, cement, fertilizers, and fuels.
The proposal details the technical and environmental requirements for the operation of projects involving the capture, use, and storage of CO₂ within the national territory. Key points highlighted include:
- Environmental and operational safety rules;
- Parameters for continuous monitoring, measurement, and verification of activities;
- Traceability and transparency criteria;
- Legal guarantees for contracts and infrastructure;
- Guidelines for integration with other public decarbonization policies.
The draft decree was prepared within the scope of the Technical Subgroup of the Permanent Technical Committee on the Fuel of the Future, an initiative that brings together government representatives, technical experts, and agents from the productive sector. Click here to access.
Next Steps
The proposal is available on the MME website and can receive contributions from civil society, the private sector, the scientific community, and other interested parties until December 16th. Suggestions should be submitted through the ministry's official platform.
Following the consultation, the text will be consolidated and could be published as an official decree as early as 2025, solidifying Brazil as one of the first countries in Latin America to comprehensively regulate carbon capture and storage technologies.
