With publication of Resolution 1.059/2023, which regulates the 14.300 Law, many professionals in the solar energy sector in Brazil have spent the last few days wondering about the validity the resolutions 482/2012 e 687/2015.
This because, despite Law 14.300 being the legislation that today defines which are the rules that need to be followed for the distributed micro and minigeneration in Brazil, he necessarily needs to be regulated through of a normative resolution of the ANEEL (National Electric Energy Agency), which is the competent body responsible for responding directly to the electric energy sector in the country.
As before the creation of Resolution 1.059, the document that was in force alongside Law 14.300 was Resolution 482, some doubts ended up becoming inevitable.
One of the main questions is: with the new resolution in force, the 482 Resolution which in April 2012 established the general conditions for consumer access to DG (distributed generation) – Has it been officially revoked?
The answer is yes, as lawyers explain Pedro Dante, from Lefosse Advogados, and Luiza Melcop, from Cortez Pimentel Advogados.
The two lawyers also make it clear that, from now on, the PROFESSIONALS that operate in the segment by GD will need consult Resolution 1.000, with the updates made by Resolution 1.059.
“Resolution 482 was revoked and no longer exists. Resolution 1.059 improved the DG rules and the regulatory provisions are in Resolution 1.000, which now incorporates the DG theme, in addition to other distribution service topics”, said Dante.
“Resolution 1.059 promoted changes in Resolution 1.000, which becomes the main consultation instrument to parameterize access requests, in addition to other rights and obligations, regarding the GD”, explained Melcop.
“Opening Resolution 1.000 in the library of ANEEL everything is already compiled there (click here) and with the appropriate changes in module 3 of the Prodist”, added the lawyer.
1.059 Resolution
The text, approved on Tuesday last week (7) during a board meeting of the ANEEL, amended Resolution 1000/2021, changing some points related to the rules for the connection and billing of micro and mini distributed generation photovoltaic plants.
The document also changed the rules of the SCEE (Electric Energy Compensation System) and changed part of the content presented in the draft by director rapporteur Helvio Guerra to adapt to what was discussed during the vote on the regulation of Law 14.300.
