A ANEEL (National Electric Energy Agency) published this Tuesday (06), in the DOU (Official Gazette of the Union) Our Attorneys  No. 2269/2024 which extends to 36 months o term so that solar and wind source projects in the GC segment (centralized generation), start commercial operations of all its generating units.

O document also deals with discounts nose TUST/TUSD (Tariffs for Use of the Transmission or Distribution System), as established in MP (Provisional Measure) 1.212, of 2024.  

As technical areas of the Agency prepared Technical Note on the new definition of the milestone for the start of works raised by the MME (Ministry of Mines and Energy) and the deadline for implementing the project defined in the grant and present in article 3 of the Ordinance.

A Technical Note was sent for the draw of reporting director and for the future board debate. Altogether, the Agency received 2.035 requests and approved 601. Of this amount, the total power was 25.521 MW. 

Between requests rejected and approved sub judice (in court proceedings), were 1.429 and 5, respectively. Ten states were included, the ones with the highest number of approved plants were: 

  • Bahia: 232 plants (152 wind and 80 solar) and 9.250 MW of power;
  • Rio Grande do Norte: 69 plants (38 wind and 31 solar) and 3.163 MW of power;
  • Minas Gerais: 65 plants (8 wind and 54 solar) and 2.724 MW of power.

Some plants filed a lawsuit with the aim of initially ensuring the extension of time provided for in the MP, without all the requirements set out in the Provisional Measure being met.

It appears in MP 1212 / 2024 that interested investors should sign the Contract of adhesion with a guarantee of faithful compliance of 5% of the value stipulated by the project. 

As artworks must be started within 18 months after the date of publication of the Provisional Measure. The provision of guarantees of faithful compliance and their validation was carried out by the B3 stock exchange.
