The delay in setting up a joint committee of the National Congress could make the provisional measure (MP) for the reform of the Brazilian electricity sector unfeasible. This is the assessment of sources in Parliament, when analyzing the progress of the text, which has already received 600 amendments (modifications) from federal deputies and senators.

The joint committee that will discuss MP 1.300/2025 was appointed on May 26. Since then, it has been awaiting installation, but not all members have been appointed by party leaders. The committee will have 13 full members and 13 alternates from each House.

According to the rules, the installation is the responsibility of the president of the National Congress, who is Senator Davi Alcolumbre (União Brasil-AP), an enemy of the Minister of Mines and Energy, Alexandre Silveira. Both are engaged in a duel behind the scenes over the nominations for the regulatory agencies.

Silveira is a man trusted by President Lula (PT). Even so, he has been a target of Alcolumbre for over a year, when the president of the Senate was still Rodrigo Pacheco (PSD-MG), a fellow countryman of the minister, who formed a partnership with his successor for appointments to the regulatory bodies.

Since the names chosen by the Executive Branch must undergo a hearing in the Senate, the Government has put the brakes on its negotiations. The tense climate of recent weeks has not helped either.

The Government was defeated in Congress on the issue of IOF (Tax on Financial Transactions), an episode that had the fingerprints of Alcolumbre and the president of the Chamber of Deputies, Hugo Motta (Republicanos-PB).

So Silveira dreams of placing his number two in the ministry, Gentil Nogueira, in one of the vacancies for the ANEEL (National Electric Energy Agency) and cannot do so. Precisely because it would need to pass through the Senate's scrutiny and uncertainty hangs in the air.

A MP of the electricity sector has been dormant in Congress for over a month, and it appears to be just the beginning. There are those who advocate withdrawing the text so that it can be passed as a bill – which would also not guarantee progress.

One of the parliamentarians closest to the electricity sector, deputy Lafayette de Andrada (Republicanos-MG), has already stated that the matter should not advance in a pre-election year. “It would take at least two years to process, and next year we will have elections,” the parliamentarian told Canal Solar, still in April, before the text of the MP reached Congress.
