Brazilian deputies are receiving a large number of complaints pointing out irregularities by electricity distributors, especially in non-compliance with deadlines for distributed micro and mini generation connections.
This fact would open up the possibility for parliamentarians to set up a CPI (Parliamentary Commission of Inquiry) to investigate the actions of concessionaires with regard to the numerous rejections, due to flow reversal, of requests for the installation of self-generation energy systems.
The information was given to the Canal Solar by federal deputy Lafayette de Andrada (Republicans/MG), current president of FREPEL (Mixed Parliamentary Front for Clean Energy).
According to the parliamentarian, although it is not the objective of a possible CPI study, nothing prevents that throughout the work, if necessary, the investigations also involve ANEEL (National Electric Energy Agency).
“A large number of complaints have reached parliamentarians pointing out recurring irregularities by distributors (…) Therefore, a movement is beginning to emerge, in fact, among parliamentarians towards the establishment of a CPI to investigate such irregularities. There is, concretely, the possibility of a CPI”, revealed Lafayette.
On Wednesday (6), the Consumer Defense Committee of the Chamber of Deputies discussed the issue of non-compliance with deadlines for connecting DG (distributed generation) systems and the problems caused by distributors with flow inversion.
According to a survey by the ombudsman's office ANEEL (National Electric Energy Agency), questions involving the topic were the second largest source of consumer complaints in September. The lack of energy continues to lead this ranking.
“In the last 12 months, there were 16.610 complaints related to the connection of microgeneration”, stated deputy Jorge Braz (Republicanos-RJ), who asked for the hearing to be held.
CPI against distributors: questions and charges
Since ANEEL regulated the Law 14.300 / 2022, through Resolution 1.059, several companies in the solar energy sector began to record losses and even close their doors.
According to professionals, distributors would be making it difficult to install photovoltaic systems by improperly using Article 73 of the new Resolution.
In several cases, distributors began to issue connection quotes with the imposition of energy injection limitations, under the allegation that this practice was necessary to overcome problems that could be caused by power flow inversion.
In almost the entire state of Minas Gerais, for example, almost all integrators now have the Requests for its customers' photovoltaic projects suspended for an indefinite period by Cemig (Companhia Energética de Minas Gerais) under the allegation that there is “network saturation”.
The complaint that the concessionaire was engaging in unfair competition in the state with projects in the solar energy sector also still generates criticism from the photovoltaic sector, which demands greater transparency from the concessionaires in the analysis of failed processes and from the competent authorities a solution to the problem.
For the president of INEL (National Institute of Clean Energy), Heber Galarce, the actions of distributors have generated major economic and social impacts.
“This arbitrary stance leads to company closures and unemployment in the sector. Precisely, in an activity capable of generating numerous jobs throughout Brazil, as it has wide reach and is largely made up of small companies,” he said.
During Wednesday's hearing, Lafayette questioned the ANEEL and also to energy distributors about what technical justifications could support the existence of disturbances as a result of flow reversal in the electrical system, making new connection requests to the transmission networks impossible.
“This issue of flow reversal is something new that emerged in Resolution 1.059, from February this year. Before that, there was no case in Brazil of a distributor even denying an access report, citing flow reversal as a justification. There has never been this before. Why have distributors started to allege this now?” asked the deputy.
“I ask the ANEEL, where did this come from? What is the calculation memory? Where are the studies that show that flow inversion is harmful to the system? What has always existed – and what is sensible and correct – was for distributors to claim disturbances in the network. Disturbance, ok. Now to say that flow inversion causes a disturbance? Where are they saying that if never before has a single distributor claimed this?”, highlighted Lafayette.
