The year 2025 has been especially intense for those who follow the electricity sector in Brasília. In Provisional Measure 1.304/2025, which dealt with the modernization of the electricity framework, one of the proposals that most worried the market was the charge of R$ 20,00 for every 100 kWh offset in distributed generation, widely reported by specialized media outlets.
In this context, the joint action of FREPEL – the Parliamentary Front for Clean Energy, under the leadership of its president, Deputy Lafayette de Andrada, and INEL – the National Institute of Clean Energy, played a prominent role in the negotiations that resulted in the removal of this charge for microgeneration alongside the load in the final text approved by Congress.
Following this successful mobilization in defense of distributed generation, INEL began to closely monitor another sensitive area: Provisional Measure 1.318/2025, which establishes REDATA for data centers. The discussion about energy costs, CDE (Energy Development Fund), and the competitiveness of new digital ventures opened space for new developments involving micro and mini-distributed generation in the parliamentary debate.
Without prejudging the merits of these proposals, INEL considers it essential to raise an alert: the legislative year is not yet over, and decisions made in the coming weeks may have lasting effects on microgeneration. Therefore, the Institute will maintain, in coordination with FREPEL and other institutional actors, a vigilant stance, closely monitoring the progress of the REDATA Provisional Measure and any attempt at alteration that may affect the legal security of solar distributed generation.
For INEL, the message is simple: defending distributed generation remains a central commitment, and technical and institutional vigilance will continue as the year turns, ensuring that the advancement of digital infrastructure is accompanied by the preservation of the achievements of distributed solar energy in Brazil.
In this same vein, the Free Solar Movement, together with the Coalition of State Fronts for Distributed Generation, reinforces its convergence with INEL in protecting microgeneration, especially in light of new political maneuvers that could reopen avenues for undue taxation or additional charges on those who generate their own energy.
The organization is closely monitoring every move of MP of REDATA It reaffirms that millions of small consumers – families, small businesses, and family farmers – already face some of the highest energy bills on the planet, finding in rooftop solar energy the only possible solution for cost reduction and energy independence.
The MSL remains mobilized and prepared for a large-scale coordinated action in Brasília, if necessary, with the goal of ensuring that microgeneration does not continue to be targeted by initiatives that compromise acquired rights and harm consumers who invested trusting in current legislation.
