Agents in the electricity sector will now have to comply with new rules from the Ministry of Mines and Energy (MME) regarding the regular submission of market and load information. The Ministry has updated procedures for this routine, promoting changes in the governance of data used for national energy planning.
The measure formalizes the creation of COPAM (Permanent Commission for Analysis and Monitoring of the Electricity Market) and redefines responsibilities related to the collection, processing, and monitoring of this information.
Among the main changes is the strengthening of the role of EPE (Energy Research Company), which will now coordinate the collection, storage and processing of sector data, in addition to assuming the role of Executive Secretariat of the new permanent commission.
The state-owned company will be responsible for providing technical support to COPAM's work and for consolidating the information that underpins studies, projections, and analyses on the evolution of the Brazilian electricity market.
The change is an update to MME Ordinance No. 331 of 2005, a regulation that has established guidelines for the submission of market and load information by agents in the electricity sector for more than two decades.
According to the ministry, the review aims to modernize the procedures used to obtain and process this data, which are considered fundamental for planning energy expansion and formulating public policies.
Permanent performance
According to the Ministry of Mines and Energy (MME), COPAM's responsibilities will include monitoring market developments, supporting improvements in the quality of information provided by market participants, and contributing to the refinement of analytical methodologies used in the sector.
The intention is to create a continuous instance for evaluating the data that serves as the basis for demand projections, expansion studies, and market analyses.
The commission will also be responsible for consolidating procedures related to the collection and processing of market and cargo information, expanding coordination among the different agents involved in the production and use of this data.
In practice, the new structure seeks to more systematically monitor the transformations in the Brazilian electricity sector, within a context of growth in the free market, expansion of renewable sources, and increased complexity of the analyses required for energy planning.
Centralization
The expectation is that centralizing these activities will contribute to increasing the consistency of information used in market projections, demand assessments, and analyses related to the expansion of energy supply in the country.
The revision of the regulation was preceded by a public consultation held between January 30 and February 28 of this year. According to the Ministry of Mines and Energy (MME), 47 contributions were received from 16 institutions.
The demonstrations resulted in adjustments to the final text of the ordinance, especially on issues related to the responsibilities of agents for sending information, the protection of data considered sensitive, and the confidentiality mechanisms applicable to COPAM meetings.
The contributions also influenced mechanisms related to the disclosure of consolidated data, seeking to reconcile transparency of information and preservation of aspects considered strategic by sector participants.
According to the ministry, the initiative is aligned with the National Energy Data Strategy, currently under development with the participation of sector institutions and support from the IEA (International Energy Agency). The project seeks to expand the integration, standardization, and governance of information used in different areas of national energy policy.
