GD's Legal Framework: how will it be processed in the Legislature?

Rapporteur of PL 5829/19, deputy Lafayette Andrada, clarifies the main changes for the DG sector in Brazil

Clarify the changes proposed by PL 5828/19 (Bill No. 5829/2019) and answer the main questions of professionals working in the DG (distributed generation) sector. This is the objective of the webinar “Legal Framework for DG: How will it be processed in the Legislature”, which will be held this Wednesday (17), at 17 pm, by Canal Solar, with the participation of the proposal's rapporteur, deputy Lafayette de Andrada.

The webinar is free and open to everyone. To register click here.

“It is a unique opportunity for the solar energy market to resolve its doubts. Understand how this PL was put together, what its main points are, especially those that guarantee the continued growth of photovoltaic solar energy on rooftops, in distributed generation. Furthermore, it will also be possible to understand how it will be processed in the Legislature, what the process is like, when it will be voted on and projections”, highlights Bruno Kikumoto, director of Canal Solar.

Bill 5829/19, which aims to create a legal framework for DG, has stirred up the entire electricity sector, mobilizing deputies, associations in the segment and civil society entities. In an interview this week with Canal Solar, Lafayette stated that the substitute text, which was included in the voting agenda in the Plenary on March 8, should be considered next week by the Chamber of Deputies.

According to the parliamentarian, the proposal aims to establish the legal framework for GD, currently regulated by REN 482 (Normative Resolution No. 482/2012) of ANEEL (National Electric Energy Agency). According to Lafayette, the changes made to the proposed replacement text aim to ensure continued growth in the sector in the country and should come into effect 12 months after the publication of the Law.

The text also determines that consumers with an access request protocol within 12 months of the publication of the Law will have the right guaranteed until 2046. For Lafayette, this measure will bring more legal security to photovoltaic projects.

Rapporteur Lafayette's replacement text was well received by associations and professionals in the DG sector. The proposal is seen with optimism and the expectation is that it will resolve the impasse due to the lack of legislation for the distributed generation segment.

Aiming to improve the text presented by Lafayette, deputies have presented amendments to be discussed during the vote on PL 5829/19. Among these amendments is the one that establishes the penetration of 10% of DG in electrical energy generation in the matrix before any change in standards and which can enable the insertion of solar energy in favelas.

    Good day, everything good?

I saw your contact as a reference to the new DG framework law, I have a doubt, if by chance I now install a DG at address vested right.
