The process of providing financial compensation to solar and wind power plants affected by generation cuts, known as curtailment, advanced this week with the release of the list of projects considered eligible to join the mechanism established by the Federal Government.
On Monday night (5), at the request of the MME (Ministry of Mines and Energy), CCEE (Chamber of Electric Energy Commercialization) published the list of plants that previously expressed interest in adhering to the Commitment Term provided for in MME Normative Ordinance No. 140/2026.
The eligibility assessment was carried out by the ONS (National Electric System Operator), considering the criteria established by the regulations. The mechanism covers eligible power cuts that occurred between September 1, 2023, and November 25, 2025.
The publication of the list, however, does not yet mean that the projects will automatically receive compensation. According to CCEE, being classified as eligible only allows the plant to proceed in the process. The effects of joining the mechanism will occur after the effective signing of the Commitment Agreement.
Official list released by CCEE.

Next stages
The publication of the list is part of a series of steps to operationalize the compensation. In July, the Ministry of Mines and Energy (MME) published Normative Ordinance No. 140/2026, which defined procedures, criteria, and deadlines for the signing of the Commitment Agreement. The regulation operationalizes the mechanism provided for in Law No. 15.269/2025.
Subsequently, on September 21, CCEE published the adapted trading rules and procedures for calculating, valuing, and operationalizing the compensations related to the period covered by the measure.
Another planned step is the training of market agents, which CCEE is expected to conduct by October 19th. For power plants with CER or CCEAR-D contracts that did not express prior interest or whose declarations were classified as ineligible, CCEE informed that the assessment of reimbursements due and the collection of suspended amounts may be resumed, when applicable.
Measures against power generation cuts
In addition to financial compensation, the Ministry of Mines and Energy (MME) states that other actions are being developed to address the generation cuts in the National Interconnected System (SIN).
In March 2025, the CMSE (Electricity Sector Monitoring Committee) determined the creation of a working group coordinated by the National Secretariat of Electric Energy, with the participation of... ANEEL (National Electric Energy Agency), EPE (Energy Research Company), ONS (National System Operator) and CCEE itself.
According to a report released by the Ministry, of the 27 actions planned by the group, 19 had been completed and eight remained in progress in September 2026. The measures include improvements to protection systems, studies to expand energy transfer capacity, and monitoring of transmission projects considered priorities.
"The action combines measures to compensate for the cuts covered by the legislation with operational and structural solutions aimed at reducing new restrictions and expanding the use of renewable generation," reported the Ministry of Mines and Energy.
