The president of FREPEL (Joint Parliamentary Front for Clean Energy), federal deputy Lafayette de Andrada (Republicans/MG), defended the need for urgency in establishment of the CPI (Parliamentary Inquiry Commission) which aims to investigate the performance of energy distributors in the DG (distributed generation) market.
The statement took place this Wednesday (27), in Brasília, during an ordinary meeting of the Mines and Energy Committee of the Chamber of Deputies.
According to the parliamentarian, the commission's objective is to analyze possible irregularities committed by electricity concessionaires with regard to non-compliance with deadlines for distributed micro and mini generation connections and also in relation to the numerous rejections due to reversal of the flow of orders for the installation of new solar energy generation systems.
“Energy distributors have invariably rejected new distributed micro and mini generation projects alleging reverse flow and failing to comply with the 14.300 Law which determines that, when rejecting an access opinion, the distributor must present studies that show the reasons why it rejected that request and this study is never presented,” he explained.
Andrada recalled that, last year, a request was sent to the MME (Ministry of Mines and Energy) asking the ANEEL (National Electric Energy Agency) to send a copy of the entire calculation report and technical studies that supported the inclusion of paragraphs 2 and 3 in article 73 of the Agency's Resolution that deals with reverse flow, with due indication of possible disturbances and disruptions caused in the distribution system of the concessionaires.
According to the president of FREPEL, the response sent by ANEEL at the beginning of March, he did not respond to any of the questions requested in the request, which increases the urgency for the establishment of the CPI.
“The importance of establishing the CPI is extremely important to investigate the activities of concessionaires that generate billions in losses for Brazil and its economy. Distributors fail to comply with Law 14.300, claiming reverse flow without presenting technical opinions, fail to comply with deadlines and even have the nerve to instruct entrepreneurs to produce solar energy from 19pm onwards”, he emphasized.
Bill of Law
This Tuesday (26), Lafayette de Andrada filed PL 970/2024 in the Chamber of Deputies, which deals with the renewal of energy distribution concessions, and reviews points of Law 14.300 of 2022, known as the MMGD Regulatory Framework .
“Faced with this scenario, the same concessionaires are still asking for the automatic renewal of concessions, which we are against and will not accept in any way,” added the deputy, during the meeting of the Mines and Energy Commission.
INEL (National Institute of Clean Energy), one of the entities representing the solar energy sector and corroborates Lafayette de Andrada's vision, said it was in favor of establishing the CPI.
The president of the institute, Heber Galarce, highlights that the actions of the distributors, with the imposition of obstacles in the analysis of connection processes for the installation of new distributed microgeneration projects, have generated major economic and social impacts since the activity is capable of generating countless jobs throughout Brazil, as it has wide coverage and is largely made up of small companies.
“The rapid establishment of the CPI will be essential to resolve obstacles that impede the growth of distributed generation, which has a lot to contribute to the electrical system and to the reduction of electricity tariffs for Brazilians, in addition to generating jobs and income. The distributors’ stance leads to company closures and unemployment in the sector,” he argued.
According to Galarce, INEL argues that dialogue is always the best way to resolve problems on issues sensitive to the clean energy sector.
“However, the institute recognizes that this dialogue lost its quality and was exhausted from the moment that technical facts were not found on the part of the distributors to resolve such a serious obstacle and which has led to the closure of companies and decimated the income of several families. All that remains is to investigate what is happening within the scope of the CPI, with the important and democratic participation of parliamentarians”, he added.
CPI in sight?
In December last year, the opening of a CPI to investigate distributors reached the minimum number of 171 signatures of a total of 581 deputies for its establishment.
According to Lafayette de Andrada, the president of the Chamber of Deputies, Arthur Lira, has already indicated that the implementation should take place in the coming weeks.
During this Wednesday's meeting, deputies Arnaldo Jardim (Cidadania-SP) and Benes Leocádio (UNIÃO-RN) also demonstrated support for the establishment of the CPI.
