The MME (Ministry of Mines and Energy) began Public Consultation No. 24 last Tuesday (187), with the aim of collecting contributions from society for the proposal that establishes new guidelines on discounts on tariffs for the use of transmission and distribution systems (TUST/TUSD) – applicable to the consumption of incentivized energy. Suggestions must be sent by July 24, 2025.
The initiative is part of actions under Provisional Measure No. 1.300/2025, aimed at modernizing the Brazilian electricity sector. The main focuses of the MP include increasing efficiency, promoting tariff justice and encouraging sustainability.
The proposal under analysis regulates one of the structural changes foreseen in the MP: the end of discounts on network usage rates for new contracts in the consumer segment, starting in 2026.
The exception will be for contracts signed and validated up to December 31, 2025, provided they are duly registered with the CCEE (Electric Energy Trading Chamber) with complete data on energy supply.

The MME highlights that the measure aims to guarantee a transition safe and transparent between the current model and the new regulatory scenario, promoting the reduction of subsidies and favoring tariff affordability, that is, the balance of electricity costs for consumers.
According to the proposed text, contracts that wish to maintain tariff benefits after the deadline must comply with requirements such as registration with the CCEE, validation of contracted volumes, identification of the parties involved and demonstration of operational flexibility.
There is also provision for an annual assessment of any deviations between the contracted volumes and those actually consumed. If differences are detected, the parties involved will have to bear an extraordinary charge, which will be directed to the CDE (Energy Development Account) as a way of compensating for the impacts and maintaining tariff balance.
The Ordinance proposes specific guidelines for situations such as:
- contracts with representation by retail agents;
- project with a permit issued, but not yet operational;
- definition of applicable deadlines and references.
