The board of ANEEL (National Electric Energy Agency) decided this Tuesday (24), by three votes to two, to extend for another 30 days the deadline for reviewing the process that could lead to the termination of Enel SP's concession.

With this decision, the topic should return to the agency's agenda on March 24th. Director Gentil Nogueira had requested a 60-day extension, but the majority of the board opted for a shorter period.

The director-general, Sandoval Feitosa, voted against the extension and anticipated his position in favor of the termination of the concession – that is, the loss of the contract by the distributor.

His vote was shared with the other directors via WhatsApp shortly before the meeting was read – a fact that generated discussions among the other directors.

During the session, Sandoval and director Fernando Mosna debated the appropriateness of presenting a substantive opinion at a time when only the extension of the analysis period was being discussed.

Directors Agnes Costa and Gentil Nogueira also questioned the director-general's premature announcement of his position, which they considered unusual at this stage of the process.

Why is the termination of Enel SP's concession under review?

The process of termination of the concession contract of ANEEL It was opened following successive criticisms of the quality of service provided by the distributor, especially after episodes of major blackouts in the city of São Paulo and the metropolitan region, which left millions of consumers without power for several days.

State and municipal authorities, as well as consumer protection agencies, have pointed to flaws in network maintenance, delays in restoring power, and insufficient staffing for emergency situations.

In addition to prolonged outages, the company's communication with consumers and its ability to respond to increasingly frequent extreme weather events were also criticized. These factors led to political and institutional pressure for the company to shut down. ANEEL to assess the possibility of revoking the concession.

What does Enel SP say?

On the other hand, Enel-SP claims that it has been making improvements to its service. According to the company, its own ANEEL It acknowledged compliance with the Recovery Plan presented in 2024, drawn up after the critical events that motivated the opening of the process.

The plan includes actions to reduce emergency response times, minimize long-term interruptions, and increase response capacity in extreme contingency situations.

According to the distributor, the percentage of prolonged interruptions fell by 86% in 2025 compared to 2023. The Average Emergency Response Time (AET) was also reduced by approximately 50% during the same period.

The final decision on whether or not the Enel-SP concession will be revoked will depend on a complete analysis of the process under review by the board of directors. ANEELwhich will assess both the identified shortcomings and the corrective measures adopted by the company.

Enel's CEO blames tree deforestation and says that "only Jesus Christ" could solve the blackouts in São Paulo.
