The Senate Bill (PLS) 524/2018, authored by Senator Rose de Freitas, was approved on 10/04/19 by the Environment Commission (CMA). The text recommends that companies that use energy predominantly from photovoltaic solar sources may be financed with resources from the Service Time Guarantee Fund (FGTS).
The art. 1st of the project amends §§ 2nd, 3rd, 9th and 10th of art. 9th of Law No. 8.036, of 1990, to include, among the entities qualified to receive credit from FGTS resources, companies that predominantly use electrical energy from photovoltaic sources.
The change promoted in § 3 still allocates, at least, one percent of the resources provided for in the FGTS application program to companies benefiting from the proposed change, also highlighting that Caixa Econômica Federal, Banco do Brasil and the National Bank for Economic Development (BNDES) must act as authorized financial agents to carry out credit operations.
The rapporteur of the proposal, Senator Jaques Wagner, also expanded the incentive to legal entities governed by private law, and not just exclusively to companies. The idea is to also include educational, health and cooperative institutions. Wagner highlighted that the Brazilian electrical matrix is already predominantly renewable, mainly due to the extensive use of water sources.
“It is known that water potential is increasingly difficult to exploit because, in general, the capacity that has not yet been explored is, to a large extent, in environmentally protected areas or on indigenous lands. Therefore, to prevent our electrical energy matrix from losing environmental quality, it is important to encourage new clean generation sources.
In this sense, incentives aimed at promoting the expansion of alternative sources of energy generation in the Brazilian matrix, such as solar – which currently represents 1,16% of the country's installed electrical capacity – are very welcome. Therefore, we can say that the initiative expressed in PLS nº 524, of 2018, is worthy”, reported Jaques Wagner in his report.
The matter will be analyzed by the Social Affairs Committee (CAS), where it will receive a final decision.
