The process created by the federal government to compensate for some of the cuts in renewable energy generation concluded its first phase with expressions of interest from 1.539 wind and solar power plants.
According to the MME (Ministry of Mines and Energy), the projects bring together around 53 GW of installed capacity, corresponding to 91% of the power used as a reference by the ONS (National System Operator) for the period covered by the mechanism. The deadline for registering expressions of interest ended on Tuesday (11).
This survey represents a preliminary assessment of adherence to the model established by the government to address part of the liability related to curtailment recorded between September 2023 and November 2025.
Final decision
Although the number of interested parties is high, participation in this phase does not guarantee that the projects will receive compensation, nor does it obligate the agents to adhere to the agreement.
The expression of interest only enables the power plants to proceed in the process. The next step will be the responsibility of the ONS (National System Operator) and the CCEE (Chamber of Electric Energy Commercialization), which are responsible for verifying which events meet the criteria defined in the regulations and calculating, individually, the volume of energy eligible for reimbursement. Only after this assessment will the generators know the results and decide whether to sign the commitment agreement.
If they choose to sign, participants will agree to the criteria adopted for determining the cuts and must waive any administrative, arbitration, and judicial actions related to the events covered by the agreement.
Scope remains limited
The mechanism regulated by Ministry of Mines and Energy Normative Ordinance No. 140/2026in compliance with Law No. 15.269 / 2025It only covers generation interruptions classified as resulting from external unavailability or electrical reliability requirements.
Therefore, cuts caused by excess energy supply in the system remain outside the scope of the agreement, an issue that continues to be one of the main demands of the renewable energy generation segment.
The regulation of reimbursements related to disconnections occurring after November 2025 will be the responsibility of... ANEEL (National Electric Energy Agency).
Meanwhile, the government argues that the discussion about the oversupply of energy should be incorporated into the modernization process of the electricity sector, involving aspects such as price formation, contracting mechanisms, and greater flexibility in system operation.
